Welcome to Bucck! This Terms of Use Agreement (“Agreement”) sets forth the terms and conditions that apply to your access and use of the online functions, products, and services made available to you by JSIF Next 2.0, LLC, DBA Bucck (“Bucck”), and any and all of its subsidiaries and affiliates.
IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER (SECTION 18). THESE PROVISIONS AFFECT YOUR RIGHTS TO RESOLVE DISPUTES WITH BUCCK. PLEASE READ THEM CAREFULLY.
1. Acceptance of Agreement
By accessing the Bucck website (www.bucck.com), the Bucck mobile application (the “Bucck App”), or any other channel provided by us (collectively, the “Bucck Site”), you agree to be bound by this Agreement. If you do not wish to be bound by these terms, do not access the Site, click “accept,” or submit any loan inquiry or application.
2. Eligibility
You may only use the Bucck Site if you are a legal resident of the United States, at least 18 years of age (or the legal age of majority in your state), and possess the legal capacity to enter into a binding contract.
3. State-Specific Disclosures & Licensing
Bucck is a licensed consumer lender. We offer credit products only to residents of the following states: Alabama, Arizona, Delaware, Florida, Georgia, Idaho, Mississippi, Missouri, New Hampshire, New Mexico, Oklahoma, South Carolina, Texas, Utah, and Wisconsin.
- Texas Residents: For questions or complaints, contact the Office of Consumer Credit Commissioner (OCCC) at 2601 N. Lamar Blvd, Austin, TX 78705, (800) 538-1579, or occc.texas.gov.
- New Mexico Residents: This lender is licensed and regulated by the New Mexico Regulation and Licensing Department, Financial Institutions Division.
- Availability: Accessing the Site from a state not listed above does not constitute an offer of credit.
4. E-Sign Agreement & Electronic Communications
To use the Bucck Site, you must agree to our E-Sign Consent. You agree that all communications, disclosures, and loan documents related to Bucck products may be provided in electronic form. Your electronic acceptance has the same legal effect as a physical signature with pen and ink.
5. Credit Reports and Loan Inquiries
By submitting an inquiry or request for a loan, you provide “written instructions” under the Fair Credit Reporting Act (FCRA) authorizing Bucck to:
- Obtain your credit report and score from one or more consumer reporting agencies.
- Use this information to verify your identity, determine creditworthiness, and advertise products to you.
- Conduct “Soft Pulls” (which do not affect your score) and “Hard Pulls” (which may affect your score) as part of the application process.
6. Automated Communications (TCPA Consent)
By providing your telephone number, you grant express written consent for Bucck and its agents to contact you via:
- Emails, telephone calls, and SMS/text messages.
- Calls and messages delivered using an automatic telephone dialing system (auto-dialer), artificial voice, or pre-recorded messages.
- Opt-Out: Text “STOP” to any SMS to unsubscribe. Text “HELP” for assistance. Standard message and data rates apply.
7. Account Security
When you create an account, you agree to use a secure and private password. You accept the risk of unauthorized access if your credentials are lost or stolen. Bucck is not responsible for unauthorized access to your account unless caused by our gross negligence.
8. Prohibited Conduct
You agree NOT to:
- Provide false, inaccurate, or incomplete information.
- Use any robot, spider, or scraper to systematically retrieve data from the Site.
- Use loan proceeds for any illegal activity or prohibited educational expenses.
- Interfere with the proper working of the Bucck Site.
9. Intellectual Property
JSIF Next 2.0, LLC owns the copyright and all intellectual property in the Bucck Site, including logos, text, graphics, and software. You may use the Site for personal, non-commercial use only. You may not modify, republish, or transmit any content without our prior written consent.
10. Risks of Online Transactions
Online information transmission can be disrupted. Bucck is not liable for technical difficulties that impair your ability to execute a transaction. You are responsible for verifying the status of any transaction by contacting info@bucck.com.
11. Privacy
Your use of the Site is governed by the Bucck Privacy Policy and GLBA Privacy Notice, which describe how we collect, use, and share your personal information. These documents are incorporated into this Agreement by reference.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUCCK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SITE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID TO US, IF ANY, DURING THE 12 MONTHS PRECEDING THE CLAIM.
13. No Warranty
THE BUCCK SITE IS PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE IS FREE OF VIRUSES OR ERRORS.
14. Indemnification
You agree to indemnify and hold harmless Bucck, its officers, and employees from any claims, losses, or expenses (including attorney’s fees) arising from your breach of this Agreement, your use of the Site, or your violation of any law.
15. External Links
The Bucck Site may contain links to third-party websites. Bucck is not responsible for the content, terms, or privacy practices of these external sites.
16. Agreement Duration and Termination
Bucck may suspend or terminate your account at any time, with or without notice, for any reason. You may deactivate your account by following the instructions on our FAQ page.
17. Governing Law
This Agreement shall be governed by the laws of the State of Utah, without regard to its conflict of laws principles.
18. DISPUTE RESOLUTION: BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS YOUR RIGHT TO A JURY TRIAL.
- Mandatory Arbitration: Any dispute or claim relating to this Agreement or the Bucck Site shall be resolved by individual binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
- Time Limit: Any claim must be filed within one (1) year after the cause of action arose, or it is forever barred.
